Legal Information

Kern Mattress Outlet sanitizes all “like new” and “gently used” mattresses.  This process is a fast-drying EPA-registered disinfectant, capable of simultaneously killing fleas, dust mites, bed bugs and many other insects while also deodorizing and sanitizing surfaces.

This process offers 11-way protection against insects, germs, and odors: viricide, bactericide, sanitizer, fungicide, insecticide, deodorant, germicide, disinfectant, mildewcide.

This is no way implies that the “like new” and “gently used” mattresses are without residual odors that may have been left behind after the sanitization process.  Our “like new” mattresses will not have any stains on them, and “gently used” will have minor stains. 

The “like new” and “gently used” mattresses sold by Kern Mattress Outlet are “as-is” and have no implied warranty and are not able to be returned for refund.  If the mattress that you are delivered does not meet your expectations you have the right and obligation to refuse delivery.  This refusal is the only recourse of the buyer. 

“As-Is”

"As is" denotes that Kern Mattress Outlet is selling, and the buyer is buying an item in whatever condition it presently exists, and that the buyer is accepting the item "with all faults", whether or not immediately apparent.  On the other hand, the phrase "as is" does not disclaim express warranties, such as those created by Kern Mattress Outlet’s description of an item. In other words, the item may be sold "as is," but if the item does not conform to Kern Mattress Outlet’s description, the buyer has a right to reject it.

New Mattress Warranty:

All new mattresses sold by Kern Mattress Outlet are warranted by the manufacturer of the mattress.  If there are any warranty claims during the warranty period the customer is to contact Kern Mattress Outlet directly.  All warranty registration and information will be delivered with the mattress.  
 
“Like New” and “Gently Used” Warranty:

There is no implied warranty for “like new” and “gently used” mattresses sold by Kern Mattress Outlet.  We do not imply in any of our product descriptions that “like new” or “gently used” implies that the mattresses are without residual odors that may have been left behind after the sanitization process.  Our “like new” mattresses will not have any stains on the mattress delivered to the customer.  Our “gently used” mattresses may have stains on the mattress delivered to the customer
